If you will be getting any benefit in the volunteer position, such as experience in your profession, contacts, or other vocational benefits, I would not consider it appropriate H-4 activities. Even if you are not being paid a salary, you are getting a professional benefit and that is a reward.

Hi I am on H4,
Yesterday my h1b was approved ( cap h1b)
I got an offer from another company , ready to file my h1b ( non -cap) asap.
My question-If i apply for h1b transfer to non-cap without working for cap company in 7-10 days and later If I want to join a cap company,will I have to go through the lottery again -basically will i be subject to cap.
2.what is the proper process for transfer to occur.
3. I do not want to inform cap company.I have the receipt number.Is it sufficient to apply for transfer.

Couple of my colleagues from 10 Aug filing in TSC got 140 approval last week, same is the case with a few from Nebraska as well, I am still stuck waiting for my I 140 even though I filed ahead of others.

Answers to some of your questions:
I am in the same situation. I have already sent my FOIA request about 3 weeks back. They have processed only 250 request in last one week. They have around 8600 requests. So it will take around 7 to 9 months to get the docs.
Since you will be asking only for I-140 and/or perm docs, there will be no cost.
You need to know SOC code/Job responsibilities/Salary for using AC-21.
Hopefully, some one who has more knowledge will reply to your other questions.

HI... we get 2 slips.. yellow and pink from HDFC.. I have my yellow slip but lost the pink slip and i have the photo copy of tht pink slip with HDFC bank stamp... will it allow me to enter the consulate at Delhi..?

My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.

Applied for AP/EAD/485 in July 07.....I know that I can invoke AC21 after 180 days and change jobs.....My question is ,
1. If I travel to India before the 180 days and use the AP when I return, is it like invoking AC21 before 180 days ?
2. what are the consequences of using AP within 180 days after filing for 485 ?
3. Is AP and AC21 related ? [brother, sister , cousin :) ]

Im just thinking aloud here. We want to be heard and we want to educate people as to how we are different from Illegal immigrants.
Why not post a question for the Republican debate? If our questions get selected and aired we will have 30 seconds of national television audience. We might even get some answers from some presidential candidates.
What i have in mind is get a few of us together, preferably people from different nationalities. Each one of us will hold a placard with
Legal Immigrant in bold, educational qualification, Federal tax paid, State tax paid, SSN tax paid and finally number of years in green card wait.
One person.. can then briefly mention what our issues are and ask what the candidate can do for us.
Each placard also has immigrationvoice.org on it...we have free advertising, we have airtime for free... and we have a national audience.
I know very well that the candidates answer may not directly help us.. but at least we will get some attention. Many many citizens watch the debate.

I have got my I 485 rejectd when i filed during AUG 2007 due to Improper fees but we paid the correct fees.We refiled with saying "Improper Denials of I-485 " and double packed saying byboss mail room. We tryied more than 5 times always we got back saying PD is not current. Please advice me how to proceed on this.

your wife's application should be tied to your PD. If you got it in EB1, then she too should be in EB1. The pearson memo will help. Get an infopass and clarify the issue.

Her and mine application (concurrent 140 and 485) was filed on July 2nd, 2007but I have not received RECEIPT # yet. Can my spouse leave USA or we have to have get Receipt # first ?
